Facie case in his favor - for if he has failed to do this, he may be nonsuited on motion of the defendant. It is therefore important for the plaintiff's counsel to know for a certainty at that time whether he has inadvertently omitted the proof of any fact required to be established by him, and equally important for the de fendant's counsel to know whether every such fact has been established by competent evidence.
