Re garding it as the distinguishing feature of our system of law that it is established by judicial decisions a pos teriori, and not deduced from a W reasonings, I have made no attempt to go further than the courts have gone; but I have desired to state, as correctly as might be, and with sufficient fulness to be intelligible, the general principles which have been declared by the courts, and the important applications which have been made of these principles.
