Description

Excerpt from Reports of Cases Argued and Determined in the English Courts of Common Law, Vol. 15: With Tables of the Cases and Principal Matters; Containing Cases in the King's Bench and Common Pleas, in 1827-9 Brackly, who was called as a witness on the trial, said he recollected no more ofthe transaction than that he had never required of the plain tiff to have a bill on any other person. Butin aletter written in Brack ly's name in 1815 (and received in evidence after a contest touching its admissibility) it was stated, - in answer to enquiries addressed to Brack ly by the defendant shortly after differences had first arisen between the defendant and the plaintiff, that the plaintiff, upon occasion of giving the bill, had said the acceptor was his uncle, and in the receipt of rents for him. The signatures of the drawer and acceptor of the bill were both in the same hand-writing, as well as the same name.
