Excerpt from Reports of Cases Argued and Determined in the Court of King's Bench, Vol. 9: With Tables of the Names of Cases and Principal Matters The testatrix died on the 24th of flfarch 1702, leaving the plaintiff, W'm. Robinson, her grandson and heir at law, and leaving also her said three daughters, her surviving. Lady Ann Jiliddleton declined to act in the trusts of the will, and having renounced the execution thereof, by indentures of lease and release of the 19th and 13th of February 1767, made after her death, the said Henry lvastell and John Rosamond being seised in fee, and one 371. Liliddleton, heir ofthe said Lady Ann, did, for the consideration therein mentioned, convey the premises in the will mentioned, in pursuance of the said agreement, unto the said Wm. Robinson. His heirs and assigns, to the uses follow ing, viz. To the use of one Adam Boulby, his executors, Sec. For the term of 2000 years, in mortgage, for securing 10281. And interest as therein mentioned, and subject thereto, upon the trusts and for the intents and purposes declared concerning the same in the will of the testatrix lilargaret Robinson. The said mortgage term of 2000 years has by divers mesne assign ments become vested in Chipchase Grey. After making the said indentures oflease and release, Ann, wife ofthe said Chipchase Grey, and daughter of the testatrix, died, leaving two children, viz. The defendants pvnz. Grey and T. R. Grey, her surviving; and Elizabeth Robinson, afterwards E. Scott, another of the tes tatrix's daughters, after the making of these indentures, also died without leaving any issue living at her death; and the defendant, lliargarct Robinson, is the surviving daughter of the testatrix.
