Excerpt from A Verbatim Report of the Cause Doe Dem; Tatham V. Wright, Vol. 1: Tried at the Lancaster Lammas Assizes, 1834, Before Mr. Baron Gurney and a Special Jury Gentlemen, in rising to ad ress you on behalf of the defendant, who is a trustee, partly for his own interest, and partly for the interest of others, I do not intend to enter into any preliminary observations of an sort whatever. I shall just call to your attention the genera? Nature of the question you are to try, remarking only, that it must be ultimately decided by your 0 inion on certain facts which it becomes necessary to detail. I sha proceed to state them, making only such remarks, and as I proceed in my address to you. As the immediate circumstances of the case may render it necessary. I shall enter into no general discussion Of any sort whatever. I shall take it for granted that in this case which we are to try, you come to the question at issue perfectly well understanding the nature of the subject we are to discuss and that all general remarks, at least for the present, would be entirely thrown away; and, therefore, I shall address myself to the real transactions in the cause, and proceed to the statement of those facts which by and bye may be given you in evidence, and thereby the more shall I consult fyour convenience and my own by so doing. I therefore, in the rst lace, proceed to state who the parties are who are interested in t '8 cause, and to give you a short history of the gentleman whose will you are to enquire into.
