Beginning with the several modes of creating a tenancy, its varieties, commencement, and termination, the work proceeds to treat of the formal parts of the instrument of demise, its execution, and the capacity of the various contracting parties thereto; ex plains the rights and liabilities generally incident to the relation of landlord and tenant, embracing the subjects of division fences and party-walls, mutual liabilities for negligence, of nuisances, easements, with the rights of way, commons, fisheries, watercourses, removal of build ings, and support from neighboring soil and buildings. It then examines the special covenants and conditions which the parties usually employ, for the purpose of limiting and defining their respective rights and duties; the consequences of an assignment of the lease, as well as of the reversion; the several modes of dissolving a tenancy, and the consequences of a dissolution, including the penalty of holding over, the right to emblement-s, and the removal of fixtures; together with the legal remedies open to either party, and a selection of the most approved precedents of leases and forms of pro ceeding. If, in the execution of the design, some topics have been omitted, or others not so fully discussed as, in the Opinion of some, the subject would seem to warrant, it is to be borne in mind that the admission of every thing connected incidentally, as well as directly, with the relation of landlord and tenant, would have 1nc1 eased the work to an extent inconsistent with the original object.
