Of Former Editions, and Containing the Cases of Michaelmas, Hilary, Easter and Trinity Terms in the Forty-Sixth Lord Eussrsoaouon, C. J Have you any case to shew where this Court has taken notice of an equitable title in a copyhold? 'does a court of law ever take notice of an equity? As a question of law there is really nothing for as to deliberate upon; and therefore we would will ine relieve you from further trouble. Lady Harriet 'never was in fact admitted, though if she had been admitted, yet according 'to the custom she could not have devised the premises without a surrender to the use of her will so that there is neither an admittance of her, nor 'a surrender to the meet her will. Then are we to be hunting alter an equity, when this Court has nothing to do but with the legal estate? For as to the admittance of the lessor. Of the plaintiff, that merely clothes 'him with a legal title tothe possession, if he had before a title to the estate pursuant to the surrender; but it does no more it will not give him a title. It is enough however to say, that Lady Harriet never was in fact admitted under the surrender by her father to the use of his will, and her devi see cannot be in a better situation than herself. It is impossible to sustain the argument for the. Lessor of the plaintili' in the total. Absence of any legal title: and we cannot determine who has the equity; he must go to the other side of the hall to learn that.
