Excerpt from Argument Made Before the Committee on the Condition of Affairs of Arkansas The constitution of a State is stable and permanent, not to be worked upon in the temper of the times, nor rise and fall with the tide of events. Notwithstanding the competition of Opposing interests, and the violence of contending parties, it remains firm and immovable as a mountain amidst the strife of storms, or a rock in the ocean amidst the raging of the waves. That the people of Arkansas, in pursuance of the reconstruction acts, framed and adopted a constitution in the year 1868, and that the State thus formed was admitted to representation in Congress, is a matter the records of Congress fully establish, and one which Congress will no doubt take judic1al cognizance of. We start, then, with the admission that the State of Arkansas, as organized under the reconstruction acts, and the constitution of 1888, was a State of the United States, and as such entitled to the protection guaranteed by the fourth section of arti cle four.
